1. About these terms

This website is operated by Elliott Best, based in Ontario, Canada (“Elliott Best”, “we”, “us”, “our”). These Terms of Service apply whenever you visit elliottbest.com or place an order with us, wherever in the world you are. By using the site or placing an order, you agree to these terms. If you don’t agree, please don’t use the site.

You must be at least the age of majority where you live to place an order.

These terms include our Shipping Policy, our Refund and Returns Policy and our Privacy Policy.

We may update these terms from time to time by posting a new version on this page. The version in place when you place an order is the one that applies to that order.

Our store is hosted by Shopify Inc., which provides the online platform we use to sell to you.

2. Our products

We sell fine art prints: restored and remastered historical artworks, original Elliott Best works, and original photography. Each print is made to order by our print production partners around the world, usually at a facility close to your delivery address.

• Colour. We do our best to show colours and details accurately, but every screen is different and printing is a physical process. Small colour differences between your screen and the finished print are normal and are not a defect.

• Images. Product photos and room mock-ups are illustrations. Scale and appearance in your own space may differ.

• Sizes. Depending on where your order is produced, a print may be made to the nearest standard metric or imperial size, so finished dimensions can differ slightly from those listed.

• Availability. We may withdraw a product, limit quantities, or change what we offer at any time.

Custom commissions, limited editions and special finishes may be produced by Elliott Best directly, on terms we confirm with you when you order.

3. Placing an order

When you place an order, you are offering to buy the items in it. We will email you an order confirmation. Your order is accepted when it goes into production.

We may decline or cancel an order, for example if a product is unavailable, there is an error in its price or description, we can’t deliver to your address, or we suspect fraud. If we cancel an order you have paid for, we will refund you in full.

You are responsible for the accuracy of your order, including the artwork, size, quantity, delivery address and contact details.

4. Prices, taxes and payment

• Prices are shown in Canadian dollars (CAD) unless another currency is displayed.

• Prices can change at any time, but changes don’t affect orders already placed.

• Shipping costs and any sales taxes that apply are calculated and shown at checkout.

• Payment is taken when you order, through secure third-party payment providers. We do not store your card details.

• If we find an error in the price of your order, we will contact you. You can confirm the order at the correct price or cancel it for a full refund.

5. Changes and cancellations

Orders go into production soon after they are placed. Email hello@elliottbest.com as soon as possible if you need to change or cancel an order, and we will do it if production hasn’t started. Once production has begun, an order can’t be changed or cancelled. See our Refund and Returns Policy.

6. Shipping and delivery

• We ship to most countries. Some destinations may be unavailable because of carrier or legal restrictions.

• Delivery times in our Shipping Policy and at checkout are estimates, not guarantees.

• Orders with more than one item may be produced at different facilities and arrive in separate parcels.

• We and our production partners choose the carrier for each order.

• You are responsible for giving a complete and accurate delivery address, and for making sure someone can receive or collect the parcel.

What happens when a parcel can’t be delivered is set out in our Refund and Returns Policy.

7. International orders, customs and import duties

Depending on where your order is produced and delivered, it may cross a border.

• The recipient is the importer of record.

• Any customs duties, import taxes, brokerage or handling fees charged by the destination country are the recipient’s responsibility. They are not included in our prices or shipping charges unless clearly shown at checkout.

• Customs processing can delay delivery, and that is outside our control.

• If you refuse a parcel or do not pay the charges due on it, it is treated as a refused delivery under our Refund and Returns Policy.

• You are responsible for making sure the products can lawfully be imported into your country.

8. Risk and ownership

The risk of loss or damage passes to you when your order is delivered to the address you gave us. You own the print once we have received payment in full.

9. Returns, refunds and replacements

Because every print is made to order, we do not accept returns for change of mind. If your order arrives damaged, defective or incorrect, or is lost in transit, we will replace it or refund you as set out in our Refund and Returns Policy, which forms part of these terms.

10. Artwork and intellectual property

The content of this site, including our restorations and remastered image files, original artworks, photographs, product descriptions, text, logos and design, is owned by or licensed to Elliott Best and is protected by copyright and other laws where they apply.

When you buy a print, you own the physical print. You do not acquire any copyright in the artwork or any right to reproduce it. You may display your print for personal enjoyment at home or at work. You may not copy, scan, reproduce, distribute or sell copies of our artwork or images, or use them commercially, without our written permission.

11. Historical artwork, brands and copyright concerns

Many of our prints are historical artworks, posters and advertisements, and they may show brand names, trademarks, products or people. They are offered as works of art and as a record of their time. Elliott Best is not affiliated with, sponsored by or endorsed by any brand, company or person shown, and all trademarks remain the property of their owners. Historical advertisements for products such as tobacco or alcohol are sold as period artwork only and are not a promotion of those products.

If you believe something on our site infringes your copyright or other rights, email hello@elliottbest.com with:

• a description of the work or right you believe has been infringed;

• where it appears on our site (the page address);

• your name and contact details; and

• a statement that you believe in good faith the use is not authorised, that your notice is accurate, and that you are the rights holder or authorised to act for them.

We will review your notice promptly and remove material where appropriate.

12. Accuracy of information

The historical and artistic information on this site is provided for general interest. We research it carefully and present attributions and dates to the best of our knowledge, but we can’t guarantee it is complete or current. We may correct errors at any time.

13. Acceptable use

You agree not to use this site:

• for any unlawful purpose, or to encourage others to break the law;

• to infringe our intellectual property rights or anyone else’s;

• to harass, abuse, defame or discriminate against anyone;

• to submit false or misleading information;

• to upload viruses or other malicious code;

• to scrape, crawl or harvest content or personal information; or

• to interfere with the security or operation of the site.

We may suspend or end your access to the site if you break these terms.

14. Reviews, comments and feedback

If you send us a review, comment or suggestion, you confirm that it is your own, that it is lawful, and that it does not infringe or defame anyone. You give us a non-exclusive, royalty-free, worldwide right to use, edit and publish it in connection with our business. We may remove any content at our discretion.

15. Third-party links and tools

Our site may link to websites or use tools that we do not control. We are not responsible for their content, products or practices. Please review their terms before you use them.

16. Personal information

How we collect and use your personal information is explained in our Privacy Policy.

17. Disclaimer of warranties

We stand behind our prints as set out in our Refund and Returns Policy. Beyond that, and to the extent the law allows, this site and our products are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not promise that the site will always be available, uninterrupted or free of errors.

Nothing in these terms removes any warranty or guarantee that the law says cannot be excluded.

18. Limitation of liability

To the fullest extent the law allows:

• we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill; and

• our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these terms limits any liability that cannot legally be limited, including liability for fraud, or for death or personal injury caused by negligence, or any rights you have as a consumer under the laws of the country where you live.

19. Indemnification

To the extent the law allows, you agree to indemnify Elliott Best and its owners, employees, partners and suppliers against third-party claims and reasonable costs that arise from your breach of these terms or your violation of any law or of anyone else’s rights.

20. Events outside our control

We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, extreme weather, strikes, carrier or customs disruption, outages, or actions of governments.

21. Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction over any dispute. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If you are a consumer living outside Ontario, the mandatory consumer protection laws of the place where you live still apply to you, and you may bring a claim to enforce them in your local courts.

22. General

• If any part of these terms is found to be invalid or unenforceable, the rest still applies.

• If we do not enforce a right straight away, we can still enforce it later.

• These terms, together with the policies named in Section 1, are the whole agreement between you and us about your use of the site and your orders.

• We may transfer our rights and obligations under these terms, for example if the business is sold. You may not transfer yours without our written consent.

• If these terms are translated, the English version governs.
